By using the Services you agree to these Terms. If you disagree, do not use the Services. The Services
We offer web design and development, published content, and—where enabled—ecommerce (listings, cart, checkout, order emails). Custom client work is also governed by separate agreements, statements of work, or signed order terms where those exist and conflict with these Terms, the specific agreement controls for that engagement.
Acceptable use
Use the Services lawfully. Do not attempt unauthorized access, disrupt security, overload or scrape the Services in a way that harms others, upload malware, harass people, send spam, misrepresent identity, or collect personal data without a proper basis.
Accounts
If accounts are available, keep credentials confidential and tell us promptly about suspected compromise. We may suspend or close accounts that break these Terms or create risk.
Orders and payments
Pricing and availability
We aim to show accurate descriptions, prices, and stock. We may fix mistakes, update listings, or refuse or cancel orders that are clearly erroneous or cannot be fulfilled.
Payment processing
Payments may be processed by third parties such as Stripe. Their terms and privacy notices apply to payment processing. You authorize us and our processors to charge your chosen payment method for amounts you owe.
Shipping, delivery, and risk
Physical goods: shipping options, costs, and timelines appear at checkout or in order messages when offered. Digital goods or services may be delivered by link, download, or agreed handover. Title and risk for physical goods follow the shipping terms shown at purchase unless the law says otherwise.
Refunds and returns
Your rights depend on what you bought and applicable consumer law. Any refund or return policy we publish on the Services (checkout, product pages, FAQs) is part of the purchase terms. Mandatory rights where you live are not waived beyond what the law allows.
Intellectual property
We and our licensors own the Services and their content except materials you supply or that third parties own. We grant a limited, non-exclusive, non-transferable licence to use the Services for personal or internal business purposes. Do not copy, modify, sell, or exploit our IP without permission, except as allowed by law.
Third-party services
Links and integrations (payments, analytics, hosting, etc.) may be offered by others. Their services are their responsibility and may have separate terms. We are not liable for third-party content or behaviour.
Disclaimers and limitation of liability
The Services are provided "as is" and "as available" to the maximum extent permitted. Where allowed, we disclaim implied warranties including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted, we are not liable for indirect, consequential, special, or punitive damages, or lost profits, data, or goodwill. Our total liability for claims relating to the Services or these Terms is limited to the greater of (a) what you paid us for the specific transaction giving rise to the claim in the twelve months before the claim or (b) SGD 100, except where liability cannot be capped (for example certain personal injury or fraud rules).
Indemnity
You will indemnify Hyperfuse Studio and its team against losses and reasonable legal fees arising from your misuse of the Services, breach of these Terms, or infringement of others’ rights, except where caused by our wilful misconduct.
Privacy
Personal data is handled as described in our Privacy Policy. Using the Services means you understand that processing may occur as set out there.
Governing law and disputes
These Terms are governed by the laws of Singapore, excluding conflict-of-law rules that would pick another law. Subject to mandatory consumer protections where you live, courts in Singapore have exclusive jurisdiction over related disputes.
Changes to these Terms
We may update these Terms; the Last updated date will change. Material changes may be highlighted on the site or by email where appropriate. Continued use after updates usually means acceptance, unless your local law requires a different process.
